1.About these terms

This website is operated by 99 Wholesale and Retail (OPC) Private Limited (CIN U47190HR2026OPC150533), registered at Gangwan Petrol Pump, Azad Nagar, Hisar 125007, Haryana, India. By browsing this website, creating an account or placing an order, you agree to these terms. If you do not agree, please do not use the website.

Our shipping, returns and refunds, cancellation, privacy and grievance redressal policies form part of these terms.

2.Using the website

You agree to use this website only for lawful purposes. You must not:

• place orders using false details or someone else’s payment method;
• copy, scrape or republish our content, images or product data;
• attempt to disrupt, overload or gain unauthorised access to the website;
• resell our products in a way that misrepresents them as your own manufacture; or
• use the website in breach of any applicable law.

We may suspend or close an account, or decline orders, where we reasonably believe these terms have been breached.

3.Your account

You are responsible for keeping your account details and password secure, and for activity carried out under your account. Tell us promptly if you believe your account has been used without your permission.

4.Products, descriptions and images

We describe our products as accurately as we can. Product photographs are for illustration; colours can appear differently on different screens, and packaging, minor design details and free accessories may change between batches. Weights, dimensions and capacities are approximate unless stated otherwise.

Where a product has an MRP, it is the manufacturer’s maximum retail price, inclusive of taxes. Our price is shown alongside it.

5.Prices and payment

Prices are in Indian Rupees and include applicable taxes unless stated otherwise. Shipping charges and any cash-on-delivery handling fee are shown in the cart before you pay.

Prices can change at any time before you place an order. If a product is listed at an incorrect price or with incorrect information because of a technical or typographical error, we may cancel the order and refund you in full, even after the order is confirmed. We will tell you before doing so.

6.Orders and when the contract is formed

Your order is an offer to buy. Our acknowledgement of the order is not acceptance. A contract is formed only when we confirm that the order, or part of it, has been dispatched.

We may decline or limit an order, in whole or in part, where the item is out of stock, the price or description was wrong, the delivery address is not serviceable, we cannot verify your details, or we reasonably suspect fraud or misuse. Where we decline an order after payment, we refund in full.

7.Bulk and wholesale orders

Bulk pricing applies to 10 or more pieces of the same product: the price per piece is reduced by 10%, rounded down to the nearest rupee, automatically at checkout. For 50 pieces or more, a quote may be issued separately; a quote is valid for the period stated on it and is subject to stock at the time of confirmation.

Bulk consignments must be checked on delivery, with damaged, defective or missing units reported within 48 hours, as set out in our returns and refunds policy.

8.Delivery, returns and cancellation

Delivery is covered by our shipping policy. Returns and refunds are covered by our returns and refunds policy, which gives you 7 days from delivery for eligible items. Cancellations are covered by our cancellation policy.

Risk in the goods passes to you on delivery. Title passes when we have received payment in full.

9.Intellectual property

The 99 Wholesale Retail name, logo, website design, text, graphics and product photography are owned by or licensed to us and are protected by law. You may not use them without our written permission, other than to view the website and place an order.

10.Third-party links and services

The website may link to third-party sites and use third-party services such as payment gateways, couriers and messaging platforms. We are not responsible for the content, policies or availability of those third parties, and their use is governed by their own terms.

11.Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or in connection with an order is limited to the amount you paid for that order.

We are not liable for indirect or consequential loss, loss of profit, loss of business, loss of opportunity, or loss arising from delay in delivery by a courier.

12.Indemnity

You agree to indemnify us against any claim, loss or expense arising from your breach of these terms, your misuse of the website, or your infringement of another person’s rights.

13.Events outside our control

We are not liable for any failure or delay in performing our obligations caused by events outside our reasonable control, including natural events, epidemics, fire, flood, strikes, transport disruption, failure of public or private telecommunications networks, or action by a government or regulator. Where such an event continues, we may cancel the affected order and refund you in full.

14.Changes to these terms

We may update these terms as our business or the law changes. The date at the top of this page shows when they were last updated. The terms that apply to your order are those in force when you place it.

15.Governing law and jurisdiction

These terms are governed by the laws of India. Subject to your rights under the Consumer Protection Act, 2019, the courts at Hisar, Haryana have exclusive jurisdiction over any dispute arising out of or in connection with them.
